NZ Citizen Family Relationship Visa (Subclass 461)
Live and work in Australia as the partner of a New Zealand citizen.
The New Zealand Citizen Family Relationship visa allows partners of NZ citizens to live and work in Australia on a temporary visa. It is designed to support families where the NZ citizen partner is either living in Australia on a Special Category Visa (SCV) subclass 444 or plans to enter Australia on one.
5 Year Validity
The visa is valid for 5 years and can be renewed indefinitely if you continue to meet requirements.
Work & Study
This visa allows unrestricted work and study rights in Australia for the entire validity period.
Travel
This visa allows unlimited travel in and out of Australia while it is valid.
Important Eligibility Note
The sponsoring NZ citizen must not be an "eligible New Zealand citizen" (a protected SCV holder from 2001). This status arises from residency on or before 26 February 2001 and may open other visa pathways such as Partner visas.
Relationship Evidence
While not quite as rigorous as the Partner visa, couples are required to provide evidence of their relationship. Evidence to support your genuine relationship can include:
- Personal statements from you, your partner, and close friends or relatives.
- Photographs and records of joint activities or travel.
- Shared financial documents such as joint bank accounts and bills.
- Joint leases or mortgages.
- Proof that you live together at the same address.

What exactly is an ‘eligible New Zealand citizen’?
An eligible New Zealand citizen is a New Zealand citizen considered a protected Special Category visa (SCV) holder under the Social Security Act 1991. You are a protected SCV holder if you:
- Were in Australia on 26 February 2001 holding an SCV, or
- Spent at least 365 days in Australia between 26 February 1999 and 25 February 2001 and returned after 26 February 2001, or
- Have confirmation from Centrelink that you meet the protected SCV criteria under the legislation.
Can I work and study in Australia on a subclass 461 visa?
Yes. This visa allows unrestricted work and study rights in Australia for the entire validity period. However, full international fees will apply.
Does the subclass 461 visa lead to permanent residency?
This visa does not itself provide a direct pathway to permanent residency, however, time spent on it may support eligibility for other visas. You may transition to permanent residency through different visa subclasses if you meet their requirements.
Can I travel outside Australia on a 461 visa?
Yes, this visa allows unlimited travel in and out of Australia while it is valid.
What happens if my relationship with the New Zealand citizen ends?
You may remain eligible for the subclass 461 visa provided you hold or held this visa, and you have not entered into a relationship with another person. To renew the visa after your relationship has ended, you must further meet residence requirements.
Can I include family members in my application?
Yes, you can include dependent children and, in some cases, other eligible family members. Each applicant must meet health and character requirements.
Can I renew my Subclass 461 visa?
Yes. You may reapply for another 461 visa if you continue to meet eligibility. There is no limit on the number of times you can renew.
Can I apply for the 461 visa if I am outside Australia?
Applications can be made either inside or outside Australia, and you can be in or outside Australia when a decision is made.
Does the 461 visa allow access to Medicare?
Holders of this visa do not automatically get access to Medicare. However, some New Zealand citizens and their families may be eligible under reciprocal health care arrangements subject to residence requirements.
Can my child born in Australia be added to my 461 visa?
Yes, if your child is born in Australia while you hold a 461 visa, they can be added to your visa.
What happens if my New Zealand family member leaves Australia?
If the New Zealand citizen leaves Australia permanently, your 461 visa may still remain valid until expiry, but future renewals could be affected if the New Zealand citizen no longer meets the visa’s eligibility conditions.
