The Skilled Nominated visa subclass 190 is a pathway to permanent residency in Australia. It allows you to live and work in Australia with nomination from state or territory government. This visa mirrors the Skilled Independent visa subclass 189 but for a few minor differences.

It is also points tested and while the minimum points requirement is 65, many skilled migrants prepare for more points to increase likelihood of invitation in competitive occupations.

How long is my EOI valid for?
Your Expression of Interest stays active for two years from the date you submit it. You can update it anytime before you receive an invitation, and it’s important to keep your details accurate if your circumstances change.
What happens if a state or territory changes its nomination requirements before I am invited?
If nomination eligibility changes after you submit your EOI, you must continue to meet the updated requirements to be nominated. While the EOI remains valid, the state or territory will not consider your application if you no longer meet their criteria.
Do I need to live in the state that nominates me?
When you accept a nomination, you commit to live and work in the nominating state or territory. While this is not a visa condition, states expect compliance and may consider this for future program participation.
Can I apply from inside or outside Australia?
Yes. You can apply either onshore or offshore. Again, states and territories may have different requirements for onshore and offshore applicants.
Can I apply from a student or temporary visa?
Yes. Many applicants transition from temporary visas by gaining skilled experience, completing a skills assessment and meeting state nomination criteria.
What occupations are eligible for the 190 visa?
Your occupation must be on an eligible skilled occupation list and also meet state nomination requirements, which vary across states and change based on labour needs.
Can a state withdraw my nomination?
States have discretion during processing. If eligibility changes or information cannot be verified, a state may choose not to proceed with nomination. It is important to maintain accuracy and eligibility throughout the process.
What happens if my English test expires before I receive an invitation?
You must have valid evidence of meeting the English requirement at the time of invitation. If your test expires before invitation, you may need to sit a new test.
What if my skills assessment expires before invitation?
Your skills assessment must be valid at the time of invitation, however following the Thapa decision and current policy, you may still meet this requirement if you obtain a new or renewed skills assessment within the 60-day invitation window. This exception applies to skills assessments only, English test results must be valid at the time of invitation.
Can I change my nominated occupation after submitting my EOI?
Yes, however this likely means you will need to start the process again as you must hold a valid skills assessment for the updated occupation at time of invitation, and changes may impact your points and eligibility. Contact us today to discuss further.
What happens if I move interstate while waiting for state or territory nomination?
