The New Zealand Citizen Family Relationship visa allows partners of NZ citizens to live and work in Australia on a temporary visa. It is designed to support families where the NZ citizen partner is either living in Australia on a Special Category Visa (SCV) subclass 444 or plans to enter Australia on one.

What exactly is an ‘eligible New Zealand citizen’?
An eligible New Zealand citizen is a New Zealand citizen considered a protected Special Category visa (SCV) holder under the Social Security Act 1991. You are a protected SCV holder if you:
  • Were in Australia on 26 February 2001 holding an SCV, or
  • Spent at least 365 days in Australia between 26 February 1999 and 25 February 2001 and returned after 26 February 2001, or
  • Have confirmation from Centrelink that you meet the protected SCV criteria under the legislation.
Can I work and study in Australia on a subclass 461 visa?
Yes. This visa allows unrestricted work and study rights in Australia for the entire validity period. However, full international fees will apply.
Does the subclass 461 visa lead to permanent residency?
This visa does not itself provide a direct pathway to permanent residency, however, time spent on it may support eligibility for other visas. You may transition to permanent residency through different visa subclasses if you meet their requirements.
